Terms of sale

Who you are buying from

myriyevskyy.com is the online gallery and shop of the painter Volodymyr Myriyevskyy, who paints in his studio on the Spanish Mediterranean coast. Every work offered here is painted by him, and the shop is run from Spain.

In these terms, "we" and "us" mean the seller identified above, and "you" means the person placing the order.

What these terms cover

These terms govern every purchase made through this website. Please read them before you buy — when you complete payment, you accept them.

They are written in English, which is the language of this site and of the contract between us. Nothing in these terms takes away the rights the law gives you as a consumer.

The paintings

Everything sold here is an original, one-of-a-kind oil painting on canvas, hand-painted by the artist. We never sell prints, giclées or reproductions of any kind. The quantity available of each painting is exactly one, because only one exists.

• Each painting is signed on the front, and signed and dated on the back.
• Each painting comes with a personalised certificate of authenticity naming you as its owner.
• Each painting ships as a stretched canvas on a wooden frame, ready to hang. We never roll a painting.

You are buying the painting exactly as it appears in its photographs on this site and as described on its page. Because screens, browsers and room light all differ, colours on your screen may vary slightly from the real painting. Oil on canvas also has its own texture and brush marks, which are part of a hand-painted original. If a painting is not as described or not as agreed, your legal rights are set out below and are unaffected by anything in this paragraph.

The artist has been selling his work since 2015; 646 paintings are now with collectors in 39 countries.

Each painting can only be sold once

Because every work is unique, it can only be sold to one person. There is no shopping cart on this site: each painting is bought on its own, one painting per order.

If two people reach checkout for the same painting at the same time, the first completed payment takes the painting. Any other payment for that same work is refunded in full, and we will write to you by email to explain and to help you find another piece if you would like one. This is how the site actually works — the painting goes to the first completed payment, the moment that payment goes through.

Prices, shipping and taxes

Prices are shown in euros (EUR) on each painting's page. Paintings currently range from around EUR 149 to over EUR 1,000. Payment is taken in euros; if your card or payment account is held in another currency, any conversion is handled by your own bank or payment provider on its own terms.

Shipping is added at checkout as a flat, insured rate chosen by destination country:

• European Union and United Kingdom: free
• Rest of Europe: EUR 29
• United States: EUR 49
• Canada, Australia, New Zealand, Singapore, Indonesia: EUR 59
• Rest of the world: EUR 68

The total you will pay — the painting plus the shipping rate for your destination — is shown to you at checkout before you confirm payment. There is nothing else to pay to us.

We do not ship to Russia or Belarus.

Until that is confirmed, this page states only what is certain: each painting is offered at one price in euros, the flat shipping rate for your destination is added at checkout, and that total is what you pay us. Customs. There are no customs charges on orders within the European Union. For destinations outside the EU, any import duties, taxes or customs handling fees are set by your own country and are your responsibility. They are not included in the painting price or in the shipping rate, and we have no way of knowing or controlling them in advance.

Payment

Payment is handled entirely by Stripe, on Stripe's own secure hosted checkout pages. You can pay by card, Apple Pay or Google Pay.

This website never sees or stores your card details. Stripe passes back to us only what we need in order to send you your painting: your name, shipping address, email, phone number and what you bought.

Nothing is charged until you complete payment on Stripe's page, and Stripe emails you the receipt as soon as the payment goes through.

How an order is placed, and when the contract is made

Buying a painting takes a few simple steps:

• You choose a painting and select your shipping destination, which sets the shipping rate.
• You are taken to Stripe's hosted checkout page, where you enter your delivery and payment details.
• Before you confirm, that page shows you what you are buying and the total to pay. You can check your details and correct any mistake there, or simply close the page and start again — nothing is charged until you confirm.
• You confirm payment. Stripe emails you the receipt.

A painting shown on this site is an invitation to buy, not a binding offer. The contract between us is formed at the moment your payment is successfully completed through Stripe — at that point the painting is yours and is no longer available to anyone else. Your Stripe receipt is your confirmation; please keep it, together with a copy of these terms as they appear on this page today. If you spot a mistake in your order after paying — a wrong address, for instance — email contact@myriyevskyy.com straight away and we will correct it if the painting has not yet been dispatched.

If, exceptionally, we cannot fulfil an order — for example because another buyer's payment for the same unique painting completed a moment earlier — we will tell you by email as soon as we know and refund you in full.

Delivery

Every shipment is insured and tracked. Orders to the United States travel by DHL Express; orders within Europe travel by Correos and local postal services.

If a painting arrives damaged, please email contact@myriyevskyy.com with photographs of the painting and of the outer packaging within [CONFIRMAR: plazo elegido por el vendedor — sugerencia: 7 días desde la entrega]. Photographs let us open the insurance claim with the carrier and sort things out for you quickly. Reporting later does not remove your legal rights below; it just makes the insurance claim harder.

Changing your mind: your 14-day right of withdrawal

If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 days, without giving any reason. The 14 days run from the day you, or someone you have named to receive it, takes physical possession of the painting.

To withdraw, simply tell us in a clear statement before the 14 days are up — an email to contact@myriyevskyy.com saying you are withdrawing is enough. You may use the model withdrawal form set out in consumer law, but you do not have to. Sending your message within the 14 days is what counts, not when we reply.

After telling us, send the painting back without undue delay and in any case within 14 days, to [COMPLETAR: domicilio postal completo — dirección para devoluciones]. Please send it back stretched and protected as it arrived, never rolled.

• We refund everything you paid us, including the standard shipping cost we charged you, within 14 days of being informed of your withdrawal.
• The refund is made through Stripe, to the same payment method you used. It costs you nothing.
• We may hold the refund until the painting is back with us, or until you show us proof that you have sent it — whichever happens first.
• You are responsible for any loss in value of the painting caused by handling it beyond what is needed to see what it is.

This right does not apply to commissioned paintings (see below), which are made to your own specification.

If something is wrong with your painting

Separately from the right to change your mind, you have a legal guarantee: the painting must be as described and as agreed. Under Spanish law this guarantee lasts three years from delivery, and if you live in another country you keep at least the minimum period your own law gives you (two years across the EU).

If a painting is not as described, write to contact@myriyevskyy.com and we will put it right. Nothing on this page limits that.

Commissions

The artist also accepts commissions — a painting made to your own specification. Commissions are currently arranged by email at contact@myriyevskyy.com: we agree the details of the work with you by email before any painting begins, and what we agree there governs the commission alongside these terms.

A commissioned painting is an original like any other work here: signed on the front, signed and dated on the back, supplied with a personalised certificate of authenticity, and shipped stretched and ready to hang.

Because a commission is made to your specification and clearly personalised, the statutory 14-day right of withdrawal does not apply to it — this is the standard exception in EU consumer law for goods made to the consumer's own specifications. Your legal guarantee for a painting that is not as agreed still applies.

Copyright

When you buy a painting you become the owner of that physical, unique object. Copyright in the work stays with the artist, Volodymyr Myriyevskyy, and is not transferred with the canvas.

This means the artist keeps the right to photograph the painting and to reproduce, publish and display those images — for example on this website and in his portfolio — including after the painting has been sold. It also means you may not reproduce the work commercially, for instance as prints, merchandise or digital products, without his written permission.

Photographing your own painting in your own home, and sharing that for personal, non-commercial reasons, is of course welcome.

The paintings, and the images of them published on this website, are protected by copyright and may not be reused commercially without permission.

Governing law and disputes

These terms are governed by Spanish law and by EU consumer law. If you are a consumer resident in another country, you keep the protection of the mandatory consumer rules of your country of residence — nothing here reduces them. As a consumer, you may also bring proceedings before the courts of the place where you live.

If something goes wrong, please write to contact@myriyevskyy.com first. We are a small studio, we read every message, and almost everything can be solved that way.

If we cannot solve it between us, you may also be able to use an out-of-court dispute resolution scheme for online purchases available to consumers in your country. We may update these terms from time to time. The version that applies to your purchase is the one published on this page at the moment you place your order.
